Spain has introduced a new law which is applicable to anyone looking to sell or rent their property.
 
The new law, Decreto 218/2005, has been introduced to offer more protection to a potential buyer or tenant and all real estate companies must comply with this.

The Junta de Andalucia are currently carrying out “spot checks” on agents - anyone found to be non-compliant are being fined heavily.

The main aim of the Decreto is to provide clients with as much accurate information relating to their intended property purchase or lease. It is now a requirement that a DIA (Documento Informativo Abreviado) form is completed prior to any viewings and that this form is made available to any prospective buyers or tenants. It is also a requirement that copies of certain documents are held by the agent.

This law also applies to properties that are currently rented or listed for rental.

The owner must provide the following documents:

  • Passport or N.I.E.
  • Nota Simple (if less than 3 months old) or Escritura (title deeds)
  • Latest electric bill
  • Latest water bill - if applicable
  • Latest IBI payment - (if you do not have this, a copy of the receipt from your bank)
    Latest Basura (rubbish) payment - (if you do not have this, a copy of the receipt from your bank)
  • Name and address of the community/administrator
  • Community rules
  • Latest community fee payment
  • All reputable companies will wish to comply with this new law.
